Mark Colthart

Mark was admitted to the bar in 1994, and has over 25 years' experience in civil and commercial litigation. He has particular expertise in commercial arbitration, construction law, and property disputes.

Mark is a full time independent arbitrator, adjudicator and expert determiner specialising in commercial, construction and complex property disputes. He brings more than 30 years of legal experience to his decision making practice.

A Fellow of AMINZ, CIArb (London) and ACICA, Mark is recognised for his expertise in both domestic and international arbitration. He sits on leading arbitration panels in New Zealand and overseas and is regularly appointed in commercial matters involving construction and infrastructure projects, commercial leases and rent reviews, business sale and purchase disputes, and high value property issues.

Mark has been consistently ranked in the Doyles Guide as a leading construction and infrastructure barrister (2017–2026). Before focusing exclusively on arbitral work, he was widely regarded as one of New Zealand’s leading construction and property law specialists.

He holds a BA/LLB from the University of Canterbury and an LLM (Hons) from the University of Auckland. Mark is a founding member of FortyEight Shortland Barristers and continues to contribute to the profession through governance roles, including service on the Executive Committee of the Property Law Section of the New Zealand Law Society.
